TERMS & CONDITIONS

1. Customer Responsibilities

The Customer represents and warrants that, except as specifically disclosed at the time of the service request, all plumbing, heating, air conditioning, electrical, and drainage systems are in serviceable condition.

The Customer agrees to indemnify and hold harmless Brass Peak Plumbing and Heating Ltd. (“BPPH”) from the discovery or existence of defective, unsafe, or non-conforming conditions, including but not limited to:

  • Improper or faulty plumbing installations

  • Rusted, deteriorated, or defective piping

  • Chemical or acid damage within drainage systems

  • Settled, collapsed, or broken lines

  • Existing illegal or non-code compliant installations

  • Roofing defects affecting mechanical systems

  • Improperly charged HVAC systems

  • Inadequate air flow or ventilation deficiencies

  • Electrical defects or improper wiring

  • Voltage irregularities supplied by the utility provider

2. Contractor Responsibilities

BPPH agrees to perform work in a competent and professional manner consistent with standard industry practices.

BPPH is not responsible for correcting or bringing into compliance any pre-existing illegal or non-conforming conditions unless specifically agreed to in writing.

3. Limited Workmanship Warranty

BPPH warrants its workmanship to be free from defects in materials and labor for a period of ninety (90) days from the date of completion unless otherwise stated in writing.

Drain cleaning and removal of blockages are not warranted unless expressly stated in writing.

This warranty is conditional upon payment in full of all invoices when due. Failure to pay voids all warranties.

This warranty applies only to the original Customer and is non-transferable.

If a defect covered by this warranty occurs, BPPH will, within a reasonable time during normal working hours, repair the defect.

BPPH shall not be liable for water damage, property damage, or other loss resulting from delay in repair.

To request warranty service, Customer must notify BPPH using the contact information provided on the invoice.

4. Warranty Exclusions

The limited warranty does not cover:

  • Conditions listed under Customer Responsibilities

  • Work performed or materials supplied by others

  • Misuse, neglect, tampering, or unauthorized alterations

  • Pre-existing system failures

  • Mold presence, growth, or detection

  • Recurring drainage blockages

THE ABOVE WARRANTY IS THE ONLY WARRANTY PROVIDED.
BPPH DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

5. Limitation of Liability

The Customer’s sole remedy is repair of defective workmanship.

BPPH shall not be liable for incidental, indirect, special, or consequential damages, including loss of use, water damage, or property damage.

6. Protection of Property

The Customer is responsible for protecting or removing personal property prior to commencement of work, including but not limited to carpets, flooring, furniture, landscaping, and valuables.

BPPH is not responsible for damage resulting from normal and necessary performance of work, including access, demolition, excavation, or restoration, including but not limited to:

Drywall, tile, cabinets, flooring, stucco, landscaping, irrigation systems, driveways, patios, sidewalks, or similar improvements.

BPPH is not responsible for damage caused by delivery personnel or for ensuring gates and doors remain closed for children or animals.

7. Payment Terms and Default

Invoices are due as stated on the invoice.

Overdue accounts shall accrue interest at 3% per month (36% per annum), compounded monthly, until paid in full.

The Customer agrees to indemnify BPPH for all collection costs, including legal fees on a solicitor-client basis.

BPPH may suspend or terminate work for non-payment without liability.

All outstanding amounts become immediately due if the Customer breaches payment obligations.

Accounts unpaid after 60 days may be forwarded for legal collection.

8. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties. No oral statements or representations modify this agreement.

This agreement is binding upon the Customer, their heirs, executors, administrators, successors, and assigns.

BPPH is not required to provide itemized breakdowns of labor and material costs unless required by law.

9. Additional Warranty Limitations

No warranty is provided on existing equipment or systems.

Any alteration, repair, or modification performed by others without written authorization from BPPH immediately voids all obligations under this agreement.
